Group appeals ruling on Kent County sale of foreclosed properties
A group of residential developers and property managers have appealed a recent ruling made by 17th Circuit Court Judge George Buth that dismissed their suit against Kent County, the County Land Bank Authority and County Treasurer Kenneth Parrish.
Last month, Buth ruled that the plaintiffs’ case had no standing in the matter and dismissed the lawsuit that was filed last fall.
The 11 plaintiffs argued that the defendants violated state law and county policy when county commissioners sold 44 tax-foreclosed properties to the land bank for $422,000 in July prior to the county’s annual auction of those properties.
County Corporate Counsel Dan Ophoff said the county was preparing a response to the appeal.
“We expected (the appeal),” Ophoff said.
