HOWELL — A dispute between Meijer and a shopper is a reminder to watch your step in the fruit aisle.

The Michigan appeals court has affirmed a decision to throw out a lawsuit filed by Nancy Duncan.

Duncan said she was injured when she slipped on grapes at a Livingston County Meijer store.

Duncan said Meijer should have known there were grapes on a floor mat in front of the fruit display. She said some grapes were brown, a suggestion they had been on the ground a while.

But the appeals court last week said it's also possible that the grapes were brown before they hit the ground.

Case dismissed.
