There are two questions that are legal for Michigan employers to ask applicants: “Have you ever been convicted of a crime?” and “Are there currently any felony charges pending against you?” If an applicant answers “yes” to either question, you cannot automatically disqualify the applicant from further consideration for the position. Though many employers still automatically disqualify applicants with criminal histories, you are creating significant risk for your organization and may just be missing out on an excellent potential employee.
