The recently published omnibus final rule finalizes changes to the privacy, security, enforcement, and breach notification rules under HIPAA that apply to sponsors of health care plans. If you maintain a self-insured health plan or are a business associate, these changes will have significant impact on your plan operations. Changes in the guidance include direct application of many of HIPAA's requirements to business associates, stronger breach notification requirements, increased penalties for noncompliance, and restrictions on the use of genetic information.
